Subject: 9418 1990-181 Jim Calfee Date: Mon, 27 Feb 1989 12:20:00 -0500 1989-181 Jim Calfee ORDINANCE NO. 9418 AN ORDINANCE CLOSING AND ABANDONING SEVENTH AVENUE LOCATED NORTHEAST FROM EAST 45TH STREET BETWEEN ROSSVILLE BOULEVARD AND 10TH AVENUE, MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned Seventh Avenue located northeast from East 45th Street between Rossville Boulevard and 10th Avenue, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: The northwest 50 feet of Seventh Avenue (a 100 foot wide right-of-way) beginning on the northwest line of East 45th Street 98.4 feet northeast of the intersection of the northwest line of East 45th Street with the northeast line of Rossville Boulevard, said point being in the southeast line of Lot 8, Block 216, East End Land Company's Addition No. 1, as shown by plat of record in Plat Book 2, Page 22, R.O.H.C., thence northeast 65.51 feet with the southeast line of Lots 8 and 7, Block 216, said subdivision, to the southeast corner of Lot 6, thence southeast at a right angle 50 feet with the southwest line of Lot 6 (if extended) to a point 50 feet northwest (if measured at a right angle) of the southeast line of Seventh Avenue, thence southwest some 45 feet parallel to, and at all points 50 feet northwest of, the southeast line of Seventh Avenue to a point 50 feet northeast of the southwest line of East 45th Street, thence northwest and southwest some 52 feet parallel to, and at all points 50 feet northeast and northwest of the southwest and southeast line of East 45th Street to the northwest line of Seventh Avenue, the point of beginning. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The Electric Power Board of Chattanooga has distribution facilities located within said right-of-way which must be maintained for the use and benefit of its customers and an easement the width of the entire right-of-way is reserved for the operation, maintenance, rebuilding, and replacement of these distribution facilities. 2. The areas reserved for utility easements must be kept free and clear of all structures. 3. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
